Evergreen Tool Company, Inc. WARRANTY for Holecutting System II

The Evergreen Tool Company warrants its Holecutting System II components and accessories to you as the original purchaser for one year from date of delivery against defects in workmanship and material. The Evergreen Tool Company will replace or repair any metal part which, in its opinion, is defective and has not been tampered with or subjected to misuse, abuse or exposed to highly corrosive conditions or has been modified except as expressly approved by Evergreen Tool Company, provided that written notice of the alleged defect shall have been given to the Evergreen Tool Company within 30 days after discovery thereof and prior to the expiration of 1 year after delivery, and further provided that if the Evergreen Tool Company so instructs, such article or part thereof, with proof of purchase, is promptly returned to the Evergreen Tool Company with shipping charges prepaid.

The above warranty is the only one given by Evergreen Tool Company concerning the Evergreen Holecutting System II components and accessories.

We specifically disclaim any other warranties, expressed or implied, including fitness for purpose and merchantability. Any liability resulting from failure of the Evergreen Holecutting System II and components thereof shall be limited to the purchase price thereof. The Evergreen Tool Company does not assume or authorize any other person to assume for it any additional liability in connection with the sale of the Evergreen Holecutting System II components and accessories.

Some states do not allow exclusion of incidental or consequential damages or limitation on how long an implied warranty lasts and, if the law of such state governs your purchase, the above exclusion and limitation may not apply to you. This warranty gives you specific legal rights and you may also have other rights, which vary from state to state.
